Blackwall VR believes in treating everyone with whom it works or communicates with respect, and that includes you. This also means respecting your privacy to the best of our ability. That means that we will not abuse or misuse the information you give us in any way. We won’t sell your information to anyone, or give it to other companies (other than within the Blackwall VR group or companies) or individuals. We won’t load up your email with junk (just an occasional email from us if you choose) or call you with any sales messages. In short, your information is safe with us.

Blackwall VR INTERNET PRIVACY AND COOKIES POLICY

General:

At Blackwall VR we are committed to safeguarding and preserving the privacy of our visitors. This privacy policy explains what happens to any personal data that you provide to us, or that we collect from you whilst you visit www.blackwallvr.com(“Website”) and how we use cookies on this Website. We do update this policy from time to time so please do review this policy regularly albeit we will advise you of any update via email or pop-up on your next visit following any such update in any case.

Information that we collect:

In running and maintaining our Website we may collect and process the following data about you: Information about your use of our site including details of your visits such as pages viewed and the resources that you access. Such information includes traffic data, location data and other communication data.

Information provided voluntarily by you. For example, when you register for information (including name, date of birth, residential address, email address, telephone number, payment information and location data). Information that you provide when you communicate with us by any means.

Information that you provide when you purchase tickets for Blackwall VR events via third-party websites such as Resident Advisor or Ticket Tailor.

Occasionally we may receive information about you from other sources, for example from any third party websites, applications or sign-in services (such as Facebook Connect) that integrate or communicate with the Website in relation to you. If so, we will add this information to the information we already hold about you in order to help us carry out the activities listed below.

In certain cases you will be required to indicate your consent to the processing of your information as set out in this privacy policy when you first submit such information to Blackwall VR.

Use of cookies:

Cookies provide information regarding the computer used by a visitor. We may use cookies where appropriate to gather information about your computer in order to assist us in improving our Website. We may gather information about your general internet use by using the cookie. Where used, these cookies are downloaded to your computer and stored on the computer’s hard drive. Such information will not identify you personally. It is statistical data which does not identify any personal details whatsoever.

Use of your information:

From 25th May 2018, under applicable Data Protection Law we may only process your information if we have a “legal basis” (i.e. a legally permitted reason) for doing so. For the purposes of this privacy policy our legal basis for processing your information is based on the provision of your consent.

We use the information that we collect from you to provide our services to you. In addition to this we may use the information for one or more of the following purposes:

To provide information to you that you request from us relating to our products, services, promotions, offers and competitions.

To inform you of any changes to our Website, services or goods and products.

Storing your personal data:

In operating our Website it may become necessary to transfer data that we collect from you to locations outside of the European Union for processing and storing. By providing your personal data to us, you agree to this transfer, storing and processing. We do our utmost to ensure that all reasonable steps are taken to make sure that your data is stored securely. Unfortunately the sending of information via the internet is not totally secure and on occasion such information can be intercepted. We cannot guarantee the security of data that you choose to send us electronically, so sending such information is entirely at your own risk.

How long will Blackwall VR keep my personal information?

We will hold your personal information on our systems until your registration is cancelled.

If you wish to cancel your Website registration, your account will be deleted upon receipt of notification to cancel. Once an account is deleted, personal information attaching to that account will not be used or processed by Blackwall VR, and will be deleted within one month of notification of account cancellation.

Where you contribute to a Website, Blackwall VR will generally only keep your content for as long as is reasonably required for the purpose(s) for which it was submitted.

If you are aged 16 or under, please obtain your parent or guardian’s permission before you provide personal information to a Website, if asked to do so on the Website. Users without this consent are not allowed to provide us with personal information.

Changes to Blackwall VR’s Privacy Policy

This privacy policy may be updated from time to time. In the event of such update, you will be notified of such changes in summary form by email or via pop-up screen on your next visit to the Website.

Access To Information

You have the right to request a copy of personal information Blackwall VR holds about you, and to have any inaccuracies corrected, under the Data Protection Act. We are entitled to charge a nominal fee to process such requests (currently £10 per request) and request that you provide proof of your identity in the form of two items of approved photographic identification (eg a passport and drivers’ licence). We will use reasonable efforts to supply, correct or delete personal information about you on our files.

Rhythmatic EULA
End-User License Agreement (EULA) of RHYTHMATIC

This End-User License Agreement ("EULA") is a legal agreement between you and BLACKWALL LABS LTD

This EULA agreement governs your acquisition and use of our RHYTHMATIC software ("Software") directly from BLACKWALL LABS LTD or indirectly through a BLACKWALL LABS LTD authorized reseller or distributor (a "Reseller").

Please read this EULA agreement carefully before completing the installation process and using the RHYTHMATIC software. It provides a license to use the RHYTHMATIC software and contains warranty information and liability disclaimers.

If you register for a free trial of the RHYTHMATIC software, this EULA agreement will also govern that trial. By clicking "accept" or installing and/or using the RHYTHMATIC software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.

This EULA agreement shall apply only to the Software supplied by BLACKWALL LABS LTD herewith regardless of whether other software is referred to or described herein. The terms also apply to any BLACKWALL LABS LTD updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant

BLACKWALL LABS LTD hereby grants you a personal, non-transferable, non-exclusive licence to use the RHYTHMATIC software on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the RHYTHMATIC software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the NYC BUNGEE software.

You are not permitted to:

Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
Reproduce, copy the Software
Allow any third party to use the Software on behalf of or for the benefit of any third party
Use the Software in any way which breaches any applicable local, national or international law
use the Software for any purpose that BLACKWALL LABS LTD considers is a breach of this EULA agreement

Intellectual Property and Ownership

BLACKWALL LABS LTD shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of BLACKWALL LABS LTD.

BLACKWALL LABS LTD reserves the right to grant licences to use the Software to third parties.

Termination

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to BLACKWALL LABS LTD.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of The United Kingdom.
